1. Acceptance of Terms

By accessing or using Vigrower ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

By using the Service, you also agree to be bound by the following additional terms and policies, which are incorporated by reference into these Terms:

2. Description of Service

Vigrower is an AI-powered YouTube analytics platform that provides video performance analysis, channel discovery, AI-generated content recommendations, and video optimization tools for YouTube content creators.

The Service uses YouTube API Services to retrieve video and channel data, and to perform actions on your YouTube channel when explicitly authorized by you. By using Vigrower, you acknowledge and agree that the Service interacts with YouTube API Services.

4. User Accounts and Authentication

To access the Service, you must create an account using a valid email address. Authentication is performed via a one-time password (OTP) sent to your email.

You agree to:

• Provide accurate and complete information when creating your account.
• Maintain the security of your account credentials and authentication tokens.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.

5. YouTube Channel Authorization

Certain features of the Service require you to authorize Vigrower to access your YouTube channel via Google OAuth. When you connect your YouTube channel:

• You grant Vigrower permission to access your YouTube channel data (channel info, video metadata) as described in our Privacy Policy.
• You grant Vigrower permission to update video metadata (titles, descriptions, tags) on your behalf, only when you explicitly initiate the "Improve Video" action.
• You may revoke Vigrower's access to your YouTube data at any time through the "My Channels" feature in the Service or via the Google security settings page.
• You acknowledge that Vigrower's use of your YouTube data is subject to the Google API Services User Data Policy, including the Limited Use requirements.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws, including the YouTube Terms of Service and YouTube Community Guidelines.
• Attempt to gain unauthorized access to the Service, its systems, or other users' accounts.
• Use automated tools (bots, scrapers, crawlers) to access the Service beyond its intended use.
• Interfere with or disrupt the integrity, performance, or availability of the Service.
• Use the Service to generate spam, misleading content, or content that violates YouTube's policies.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Attempt to circumvent any rate limiting, quota restrictions, or security measures of the Service.
• Use the Service to collect or harvest personal information of other users.
• Redistribute, sublicense, or resell access to the Service or data obtained through it.

7. YouTube Data and Content

You acknowledge and agree that:

• All YouTube content (videos, thumbnails, channel branding, etc.) remains the property of its respective owners and is subject to YouTube's Terms of Service.
• Vigrower does not claim ownership of any YouTube content displayed or analyzed through the Service.
• AI-generated recommendations are suggestions only. You are solely responsible for any changes you make to your YouTube videos using the Service.
• The Service retrieves data from the YouTube Data API. The accuracy and availability of this data is subject to YouTube's systems and policies.
• We do not guarantee the accuracy, completeness, or timeliness of any YouTube data or AI-generated recommendations.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and share your information, including data obtained from YouTube API Services. By using the Service, you consent to the practices described in our Privacy Policy.

Our Privacy Policy is prominently displayed and accessible at all times via the footer of our website.

9. Intellectual Property

The Service, including its design, user interface, features, code, and original content (excluding user-generated content, YouTube data, and third-party content), is owned by Vigrower and is protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, sublicense, or reverse engineer any part of the Service without our prior written consent.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free.
• The results obtained from the Service (including AI recommendations) will be accurate, reliable, or complete.
• Any changes made to your YouTube content based on AI recommendations will result in improved performance.
• The Service will be compatible with all devices, browsers, or operating systems.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Vigrower and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, loss of YouTube channel performance, or loss of business opportunities, arising out of or related to your use of the Service, regardless of the cause of action or theory of liability.

In no event shall our total aggregate liability exceed the amount you have paid us (if any) for the Service in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Vigrower and its owners, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of the YouTube Terms of Service or any other applicable third-party terms.
• Any content you create, modify, or publish using the Service.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including but not limited to cases where:

• You violate these Terms or any applicable laws.
• You violate the YouTube Terms of Service or YouTube's Developer Policies.
• Your use of the Service poses a security risk or may cause harm to other users.
• We are required to do so by law or by YouTube/Google.

Upon termination, your right to use the Service will immediately cease. We will delete your stored data in accordance with our Privacy Policy. You may also revoke Vigrower's access to your YouTube data via the Google security settings page.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a revised "Last updated" date.

Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service and may request deletion of your account.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if necessary, through binding arbitration or in a court of competent jurisdiction.
